Chapter 7 Bankruptcy

Chapter 7 bankruptcy is available for people with an income below the median income in Virginia for a household of their size. People with many unsecured assets elect to file a Chapter 7 to relieve them from liability from their debts. Credit cards, medical bills and certain taxes are unsecured debts. Under Chapter 7, these debts will be discharged. You may also discharge secured debts as long as you return the collateral to the lender. If you want to keep assets such as your house or car, for example, you must continue to make the loan payments. Our attorneys’ fees for Chapter 7 are $800 plus court costs. The Automatic Stay

All chapters of bankruptcy protect the automatic stay, which halts all collection actions during the bankruptcy, including creditor harassment and:

• Wage garnishment
• Foreclosure
• Vehicle repossession

The automatic stay does not discharge your obligation to pay court-ordered alimony/spousal support or child support, however. Typically, student loans and injury/wrongful death judgments against you are not dischargeable.
